Vietnam Introduces Stricter Penalties for Lottery Regulations

Vietnam’s Ministry of Finance has unveiled a proposal for updated regulations aimed at enforcing stricter administrative penalties within the lottery sector. This initiative is part of a broader draft decree intended to modernize and enhance existing legal frameworks for better governance.

The proposal seeks to rename Decree No. 98/2013/ND-CP to emphasize its focus solely on lotteries, removing previous references to insurance under updated laws. This necessary change aims to delineate the law's scope and ensure precise applicability.

Furthermore, there are calls to modify the enforcement power structure. With the proposed changes to the inspection system, certain roles, such as financial inspectors, will no longer have authority to impose penalties, aligning the regulations with current administrative practices.

On the other hand, the draft empowers new positions, including heads of inspection teams and high-ranking officials within the finance ministry. These individuals would possess the authority to issue warnings, levy fines, confiscate evidence, and implement corrective measures for regulatory breaches.

Additionally, provincial leaders, such as chairpersons of People’s Committees and finance department directors, will receive clearer authority to impose fines, suspend operations, and enforce compliance within their jurisdictions.

Law enforcement agencies are also poised to have expanded roles under the new draft. Police and specialized units tackling economic and cybercrime will be authorized to issue warnings, impose fines, and take necessary actions against violators in the lottery sector.

These proposed regulations aim to foster transparency, enhance oversight, and ensure compliance within Vietnam’s lottery business. If ratified, the decree will be a significant step towards modernizing regulatory practices and improving governance in the industry.
