X Defends Twitter Trademark in Legal Battle

The social media entity X, formerly Twitter, has updated its Terms of Service and launched a legal countersuit to strengthen its claim on the Twitter trademark. This action follows a threat from Virginia-based startup Operation Bluebird, which is challenging X’s intellectual property rights.

The revised Terms of Service, set to take effect on January 15, 2026, specifically prohibit users from utilizing the Twitter name, logos, trademarks, domain names, or any associated brand identifiers without explicit written consent. This is the first occasion the social media platform has formally recognized Twitter alongside X in its legal documentation. Additional minor updates addressing EU regulations and age-assurance technology have also been made.

Operation Bluebird has submitted a petition to the U.S. Patent and Trademark Office (USPTO) to annul X’s rights to the Twitter and Tweet trademarks, contending that these trademarks were abandoned following the rebranding. The startup has also filed a trademark application for a new platform named Twitter.new.

In retaliation, X initiated a federal countersuit in Delaware, asserting that the Twitter brand continues to be in active use and enjoys public acknowledgment. Legal analysts point out that under U.S. trademark law, rights may expire if a brand is not actively utilized; however, companies can defend their well-known marks by demonstrating continued usage or public affiliation. X reiterates that users continue to access the platform through the legacy twitter.com URL, bolstering the brand's ongoing recognition.

This legal dispute emphasizes the significance of intellectual property in today's digital landscape, especially for platforms undergoing significant rebranding. The resolution of this case could establish a crucial precedent for how tech companies safeguard trademarks amid structural or identity transformations.
