Vietnam Introduces Forensic Examination Regulations in Science and Technology

In a significant development, Vietnam's Ministry of Science and Technology has issued a circular establishing new regulations for forensic examinations that pertain to science and technology sectors. This initiative aims to bolster legal processes and ascertain qualified expertise in scientific and technical inquiries.

The circular specifies that forensic examinations encompass evaluations on specialized matters sanctioned by both the Ministry and local authorities. Areas affected by this regulation include innovation, digital technologies, telecommunications, intellectual property, and various scientific disciplines.

Individuals designated as forensic experts must adhere to stringent criteria outlined in the Law on Forensic Expertise. These prerequisites include possessing commendable moral integrity, a university degree, and at least five years of relevant professional experience.

Alternatively, those who have actively participated in forensic operations may qualify with a minimum of three years of hands-on experience. Furthermore, candidates must undergo training in both legal principles and forensic methodologies before they can be considered for expert roles.

The regulation stipulates that academic qualifications must be recognized within Vietnam, regardless of whether they are earned domestically or internationally. Experience must be relevant to the area of expertise specified, measured from the beginning of employment to the application submission.

A detailed process has been outlined for the appointment of forensic experts and the issuance of official certification. While the Ministry of Science and Technology is responsible for national level appointments, local authorities will oversee hires within their respective regions.

This procedure involves the review of applications, evaluations by pertinent departments, and final approvals by the Minister, all within specified timeframes. Once confirmed, the list of appointed experts will be made publicly available to uphold transparency.

Ultimately, this new circular is anticipated to enhance the integrity and standard of forensic examinations in Vietnam's science and technology sectors, thereby supporting legal frameworks and fostering greater trust in technical investigations throughout the nation.
