Vietnam Reaffirms Local Government Powers in Environmental Inspections

Vietnam has reaffirmed the authority of local governmental bodies in enforcing environmental laws, clarifying that officials at the commune level possess the right to inspect businesses for compliance. This decision follows a request from a garment industry firm based in Dong Thap.

The Ministry of Agriculture and Environment reiterated that the powers of inspection are clearly articulated in the 2020 Law on Environmental Protection, along with subsequent amendments. These regulations empower local authorities, including those at the commune level, to undertake specific inspections related to environmental safeguarding.

According to ministry officials, the Chairman of the People’s Committee at the commune level can oversee and enforce environmental compliance within their jurisdiction. This move guarantees that environmental standards are upheld even at the local administrative tier.

The legal foundation for these powers is bolstered by various regulations, including provisions stated in the amended laws and Government Decree No. 217 issued in 2025. These guidelines outline the procedures and responsibilities that facilitate effective and transparent inspections.

Officials have emphasized the necessity for businesses to adhere to environmental laws irrespective of the authority level conducting inspections. Companies with environmental permits are still subject to periodic monitoring to ensure they continue to meet required standards.

This clarification aims to reinforce enforcement frameworks and ensure consistent application of environmental protections nationwide. By empowering local authorities, the government intends to enhance oversight capabilities and mitigate violations early.

The ministry also mentioned that these initiatives are part of broader strategies to foster sustainable development and conserve natural resources. Strengthening local inspection authority is anticipated to improve accountability and environmental governance throughout the country.
