Mumbai: The Bombay High Court has denied Bollywood actress Shilpa Shetty’s request to lift her lookout notice in a high-profile financial case involving her husband, businessman Raj Kundra. The case concerns alleged fraud worth approximately Rs60 crore connected to Kundra’s now-defunct company, Best Deal TV Private Limited.
Shilpa Shetty had approached the court claiming that she was only a nominal director in the company and did not have any active role in its operations. She requested permission to travel abroad, arguing that her involvement in the company was limited and that she should not be restricted.
However, the court, led by Chief Justice Shree Chandrashekhar and Justice Gautam Ankhad, rejected her plea. The judges made it clear that repayment of the disputed amount to the complainant is necessary before granting any travel or relief. “If you wish to travel abroad, first become a government witness,” the bench said, emphasizing the seriousness of the case.
The court also ordered Shilpa Shetty to submit a written affidavit by October 16 explaining her connection with the company. Raj Kundra, on his part, has been directed to file an affidavit confirming that Shilpa Shetty was not actively involved in the company’s affairs.
Background of the Case
The case started with a complaint by businessman Deepak Kothari, who claimed that loans and investments totaling Rs60 crore, made between 2015 and 2023 in Best Deal TV, were allegedly misused for personal purposes. Raj Kundra defended himself by stating that the company suffered heavy losses after demonetisation, which prevented repayment of the loans.
Both Shilpa Shetty and Raj Kundra have cooperated with authorities so far. Shilpa Shetty was questioned for over four hours at her residence on October 4, while Kundra has appeared before the Economic Offences Wing (EOW) on two occasions. Despite their cooperation, the court made it clear that no travel or further relief will be allowed until the full amount of Rs60 crore is repaid to the complainant.
Judicial Focus on Accountability
This ruling highlights the court’s strict stance on financial accountability, especially in high-profile cases. It also shows that legal processes take precedence over personal convenience or celebrity status. By refusing Shilpa Shetty’s request, the court emphasized that individuals involved in ongoing investigations cannot freely travel until their obligations are clarified or resolved.
The decision sends a strong message to both businesspersons and public figures that cooperation with authorities and financial responsibility are crucial. It also underscores the judiciary’s focus on protecting investors’ rights and ensuring that alleged financial misconduct is addressed before granting any special privileges.
Disclaimer
The Bombay High Court’s decision in the Shilpa Shetty-Raj Kundra case is a reminder that legal rules apply equally to everyone, regardless of status or fame. While the couple has been cooperative, the repayment of the alleged Rs60 crore fraud remains a key requirement for any relief, including travel abroad.
