In a significant legal step, Chinese surveillance leader Hikvision has declared that its U.S. subsidiary is challenging a recent Federal Communications Commission (FCC) regulation that imposes stricter limitations on telecommunications equipment from China. This rule seeks to reduce national security threats by prohibiting new approvals for devices containing components from companies listed on the FCC's “Covered List” and also permits the revocation of previously granted authorizations.
Hikvision contends that the FCC has overstepped its bounds, arguing that the agency “aims to retroactively limit lawful authorizations without adequate legal or evidential justification.” The company claims its petition is intended to protect its market rights and create a more predictable regulatory framework for legitimate businesses and clients.
The FCC has previously categorized Hikvision, along with Huawei, ZTE, China Mobile, and China Telecom, on the Covered List, which effectively prohibits these companies from obtaining U.S. sales or import approvals for new devices. Recently, leading online retailers have eliminated millions of restricted listings for products, such as home security cameras and smartwatches, associated with these Chinese enterprises.
This is not Hikvision's first encounter with U.S. regulatory challenges. In February, a U.S. appeals court declined the company's effort to overturn a 2022 prohibition on its new video surveillance and telecommunications products. The FCC has similarly scrutinized other firms, including Hong Kong-based HKT, highlighting a stricter examination of foreign telecommunications companies.
Hikvision underscores that this legal action aims to preserve market stability and safeguard the interests of partners and consumers amid an increasingly convoluted regulatory environment.
