Concern is growing among Indian professionals as numerous H-1B visa holders find themselves stranded in India after their visa interviews were unexpectedly postponed.

Earlier this month, many individuals were in India to renew their H-1B work permits, having secured interview slots at US consulates scheduled between December 15 and December 26, coinciding with the US holiday season.

Yet, without prior notice, these interviews have been deferred to March of next year.

Reason Behind the Delay

The US State Department communicated via email to those affected, attributing the delays to a newly implemented social media screening policy.

This regulation mandates visa officials to examine social media profiles of applicants to ensure no threats to national security or public safety arise from the applicants.

Consequently, many H-1B visa holders are left unable to return to their jobs in the US.

Workers in Distress

Numerous legal firms report an influx of cases from stranded workers, with experts labeling this as one of the most challenging situations in recent years.

Several emigrants returned to India for celebrations, expecting to swiftly return, but with their prior appointments expired, they face uncertainty in their return.

Heightened worries loom as firms in the US may not be willing to hold positions indefinitely, jeopardizing employment.

US Embassy Advisory

A clear notification from the US Embassy in India on December 9 stated that individuals arriving at the embassy on old interview dates following a reschedule notification would be denied entry.

Applicants are advised to attend only on their newly assigned dates.

Prevalence of H-1B Workers from India

With approximately 71% of all H-1B visa holders being Indian, this delay gravely impacts a substantial group of workers.

The plight of H-1B visa holders stranded in India is now a pressing concern affecting families, corporations, and legal advocates alike.

Tech Firms Issue Advisory

Prominent tech companies have noted this crisis, warning employees against traveling outside the US.

They cautioned that visa processing delays at US embassies could extend up to 12 months, indicating potential extended absences for employees.

Increased Scrutiny on H-1B Program

The new social media regulations form part of more rigid protocols surrounding the H-1B program, previously confined to students but now extended to workers.

Over recent months, the US government has enacted several stringent measures, including:

  • Additional fees for new H-1B visas

  • Suspension of certain immigration applications from specified countries

These developments have intensified the concerns of countless H-1B visa holders stuck in India.

Significance of This Situation

This situation poses a grave challenge for Indian professionals in the US, leaving many anxious about their jobs, income, and families.

Until interview delays are resolved, the challenges faced by H-1B visa holders stuck in India are anticipated to persist.
