Vietnam has taken significant action against illegal forest encroachment and unauthorized usage by implementing a new decree aimed at bolstering environmental protections. Announced on May 6, 2026, Decree No. 146/2026/ND-CP introduces enhanced penalties within the forestry sector, reflecting the government's commitment to uphold forest conservation.
This decree encompasses 42 articles addressing various forestry offenses such as illegal deforestation, unauthorized occupation, and violations related to forest products and fires. Both domestic and international entities operating in Vietnam must adhere to these regulations.
The fines under the new framework can reach VND 500 million for individuals and up to VND 1 billion for organizations. The government aims to deter illegal land use and protect vital forest areas, which are crucial for biodiversity and ecological sustainability.
The decree specifies fines according to the type of forest and scale of violation. Encroachments involving production, protective, and special-use forests might incur penalties starting at VND 1 million. Yet, more extensive infringements, especially in natural forests, could see fines escalate to double standard amounts owing to their ecological significance.
New regulations have also been laid out concerning unauthorized tourism in forest areas. Tours conducted without forest owner approval face fines between VND 4 million and VND 6 million, while businesses operating in protected zones without permits could face steeper penalties.
The decree focuses on preventing illegal developments in vulnerable forest regions. Investors in ecotourism not adhering to established environmental plans may incur fines up to VND 50 million and be required to restore affected areas.
Additionally, the unauthorized harvesting of medicinal plants in protected areas falls under this crackdown. The government warns that such exploitation jeopardizes fragile ecosystems and natural balance, with violators facing more severe penalties under existing forestry laws.
As Vietnam confronts rising environmental issues such as climate change and biodiversity degradation, the government reiterates forest conservation as a top priority. Enhanced enforcement and robust monitoring are expected to mitigate illegal activities and safeguard forest ecosystems for future generations.
This decree is set to be implemented on June 25, 2026, replacing previous forestry penalty regulations from 2019 and 2022. Authorities assert that this new framework reinforces Vietnam's dedication to sustainable environmental governance and stronger protective measures for forests and wildlife.
