In a significant ruling, South Korea’s appeals court has cut the prison sentence of former Prime Minister Han Duck-soo related to a pivotal martial law rebellion trial involving former President Yoon Suk Yeol. This decision reflects ongoing turbulence in the political landscape following the controversial martial law declaration in December 2024.
On Thursday, the Seoul High Court reduced the original 23-year sentence to 15 years. While the court upheld the predominant serious charges, judges opted for a leniency in sentencing after assessing the circumstances surrounding the case and previous judgements of related officials.
The court maintained that Han was significantly involved in endorsing the unconstitutional martial law decree by then-President Yoon Suk Yeol. Prosecutors claimed he sought to legitimize the controversial decree by convening a Cabinet meeting and discussing strategies that impacted major media outlets.
The court affirmed charges of falsifying martial law documents, destruction of official records, and giving false testimonies during investigations. The verdict highlighted Han's failures as a senior government official and his participation in actions detrimental to the nation's constitutional order.
The martial law crisis is regarded as a critical event in South Korean history, with the declaration by former President Yoon Suk Yeol inciting extensive political unrest and public protests. It led to legal inquiries, impeachment efforts, and criminal proceedings against several high-ranking officials.
Earlier this year, former President Yoon Suk Yeol received a life sentence for rebellion linked to the martial law declaration. Other officials, including ex-Interior Minister Lee Sang-min, also faced significant prison terms as a result of their involvement.
Legal professionals in Seoul have commented that while the appeals court regarded Han’s crimes as severe, it may have factored in the desire for consistent sentencing with other officials involved. Analysts believe that the adjustment to 15 years aims to maintain a balance between accountability and established legal principles seen in similar cases.
At 76, Han Duck-soo has had a long career in public service, serving as Prime Minister twice—first under former President Roh Moo-hyun and later under the now-impeached President Yoon Suk Yeol. During the political turmoil, he briefly acted as a caretaker leader following Yoon's suspension.
Both prosecutors and Han’s defense team have a week to contest the ruling before the Supreme Court of South Korea. The case remains a focal point of national debate as South Korea navigates the far-reaching implications of the disrupted martial law attempt and ongoing leadership issues.
