A Utah judge has heard arguments over whether the prosecution team handling the murder case of conservative activist Charlie Kirk should be removed due to an alleged conflict of interest. The hearing, held on Friday, focused on claims by the defense that personal connections within the prosecutor’s office could affect the fairness of the trial.
District Court Judge Tony Graf is considering a request to disqualify the Utah County Attorney’s Office from prosecuting Tyler Robinson, who is accused of killing Kirk during a campus event last year. The defense argues that the case has been influenced by emotion rather than law because the daughter of a senior prosecutor was present when Kirk was shot.
Charlie Kirk, the founder of Turning Point USA, was shot and killed on September 10 while speaking with students at Utah Valley University in Orem. He was well known for mobilizing young conservative voters and played a key role in helping President Donald Trump win the 2024 election. His killing shocked the nation and added to growing fears about political violence in the United States.
Robinson, 22, is accused of firing a single gunshot from a rooftop that struck Kirk as he debated students. Prosecutors say the act was deliberate and dangerous, putting many lives at risk. Robinson faces seven criminal charges, including aggravated murder, obstruction of justice for allegedly disposing of evidence, and witness tampering for asking his roommate to delete messages.
During the hearing, Robinson appeared calm and was seen smiling at times. Judge Graf ordered that courtroom cameras not record close-up video of Robinson speaking with his lawyer, citing concerns that people could try to read their lips.
Defense attorney Richard Novak argued that the prosecution team acted with strong emotion shortly after Kirk’s death. He pointed to the decision to seek the death penalty less than a week after the shooting as proof of bias. Novak said the senior prosecutor whose daughter witnessed the shooting should have been separated from the case, but no such steps were taken.
Novak told the court that text messages sent by the prosecutor’s daughter, describing the shooting, were shared within the prosecution team. He said this created a conflict that now affects the entire office and undermines Robinson’s right to a fair trial.
Utah County Attorney Jeffrey Gray strongly rejected these claims. He testified that the prosecutor’s daughter was just one of thousands of people at the university that day and did not witness anything in dispute. Gray said there was no conflict of interest and that her father’s role did not influence the case.
Gray also explained that the decision to seek the death penalty was based on the seriousness of the crime, not emotion. He said the shooting was carried out in a public place and endangered many people, which justified the toughest possible charge under the law.
Much of the hearing focused on whether the Utah Attorney General’s Office should respond to the defense request instead of the county prosecutor’s office. Judge Graf did not make an immediate ruling and said the matter would be reviewed further.
The next court hearing is scheduled for February 3. As the case continues, it remains closely watched across the country, both for its legal implications and for what it says about rising political tension and violence in the United States.
