European Developers Challenge Apple’s Pricing System

A coalition of 20 app developers and consumer advocacy groups in Europe has pressed regulators to take action against Apple, asserting that the App Store fees still create an uneven playing field for European developers in comparison to their U.S. counterparts.

This appeal follows a recent U.S. court ruling that restricts Apple’s potential to charge fees on external transactions, underscoring a widening disparity between the operational conditions for developers on both sides of the Atlantic.

According to the EU’s Digital Markets Act (DMA), major tech firms like Apple—identified as “gatekeepers”—are mandated to permit in-app payments outside their own ecosystems without imposing additional fees. However, Apple's new policies continue to impose fees between 13% for smaller businesses and 20% for transactions on the App Store, alongside further penalties of 5% to 15% for external payment processes.

The Coalition for Apps Fairness (CAF), which comprises firms like Deezer and Proton, insists that these policies remain in violation of EU regulations. Advocates emphasize that European developers are left with no choice but to absorb these costs or transfer them to consumers, resulting in a competitive disadvantage.

Following the European Commission's €500 million fine against Apple for breaching the DMA six months ago, developers contend that the newly implemented terms do not fully align with EU requirements, leaving uncertainties surrounding policy updates set for January.

Industry experts highlight that this ambiguity not only stifles innovation but also disrupts the overall app ecosystem in Europe, as smaller developers find it increasingly challenging to compete under a more burdensome fee structure than that faced by their U.S. counterparts.
