South Korean President Yoon Faces Death Penalty Charge for Coup Allegations

The special prosecutor in South Korea has formally moved to impose the death penalty on former President Yoon Suk Yeol, claiming he orchestrated an insurrection tied to his brief martial law declaration in December 2024. This request emerged during the closing arguments at the Seoul Central District Court on Tuesday, representing one of the gravest legal actions against a past leader in the nation’s history.

Prosecutors revealed in court that an extensive plot allegedly orchestrated by Yoon and his former defence minister, Kim Yong-hyun, aimed at extending Yoon’s tenure beyond constitutional limits. This scheme reportedly commenced as far back as October 2023 and culminated in the shocking and controversial decision to implement martial law, which elicited a significant political uproar.

The special prosecutor contended that the martial law declaration was not a spontaneous act born out of immediate crisis but rather a calculated decision that involved crucial figures from Yoon’s former administration. Investigations suggest that the strategy was designed to manipulate state institutions and stifle dissent, actions seen as qualifying for insurrection under South Korean laws.

With the prosecution calling for the death penalty, this case takes on historical significance, since South Korea has not executed anyone in nearly 30 years, maintaining a de facto moratorium on capital punishment despite its legality for serious offenses like treason and insurrection.

Yoon, who firmly denies all charges, was unavailable for comment immediately after the hearing. His legal representatives have consistently stated that the martial law was enacted solely to preserve stability and does not constitute an attempt to undermine the constitutional regime.

The court will continue its deliberations, with a verdict expected later. The eventual ruling may profoundly influence South Korea’s political framework, the accountability mechanisms for former officials, and discussions surrounding capital punishment in the nation.
