Amazon has initiated legal proceedings against the New York State Public Employment Relations Board (PERB) to prevent the enforcement of Senate Bill 8034A. The company contends that the new state law unlawfully expands state authority over private-sector labor relations, traditionally under the purview of the federal National Labor Relations Board (NLRB).
Filed in the U.S. District Court for the Eastern District of New York, Amazon's lawsuit argues that Senate Bill 8034A constitutes an unconstitutional overreach by permitting PERB to assume jurisdiction over union organizing, collective bargaining, and workplace disputes in the private sector. The company asserts that this presumption of state authority conflicts with federal labor law and undermines the NLRB's established role.
The legal dispute intensified following the August 9 termination of Brima Sylla, a vice president of a local union at Amazon's JFK8 warehouse in Staten Island. Despite the NLRB's concurrent review of the matter, PERB filed a charge under the new state law, prompting Amazon to challenge the law's validity in federal court.
Governor Kathy Hochul signed Senate Bill 8034A into law on September 5, citing the NLRB's lack of quorum and the resulting backlog of cases as justification for state intervention. The governor emphasized the need to protect workers' rights in the face of federal delays.
Amazon's lawsuit reflects a broader tension between state and federal authority in labor relations. The NLRB itself has filed a separate lawsuit against New York, seeking to block the enforcement of Senate Bill 8034A on similar constitutional grounds.
