Attorneys representing hip-hop mogul Sean “Diddy” Combs have filed an appeal in a federal court in New York, seeking to overturn his conviction connected to prostitution or to obtain his immediate release from incarceration. They argue that the sentencing judge placed undue emphasis on charges that the jury had acquitted, leading to an excessively harsh sentence.
In documents submitted to the 2nd U.S. Circuit Court of Appeals in Manhattan on Tuesday, Combs’ legal team asserted that the sentencing process lacked essential fairness. They criticized U.S. District Judge Arun Subramanian for relying on testimony related to charges of racketeering and sex trafficking from which Combs was found not guilty earlier this year.
Currently, the 56-year-old Combs is serving a sentence of four years and two months at a federal prison in New Jersey, with a release date set for May 2028. While he was acquitted of serious charges, including racketeering conspiracy and sex trafficking, he was convicted under the Mann Act for crossing state lines for the purpose of prostitution.
The appeal argues that Judge Subramanian effectively acted as a “thirteenth juror,” by reassessing allegations that the jury had dismissed. The defense maintained that Combs was convicted of two lesser charges that did not involve coercion or fraud—offenses that usually carry much lighter sentences.
The legal filing highlighted that defendants in similar situations as Combs usually face sentences below 15 months, contending that his sentence was unusually severe and lacked precedent for comparable convictions.
During the sentencing, the judge cited testimony from two former partners who accused Combs of abusive behavior. One of these individuals, singer Casandra “Cassie” Ventura, testified that she felt pressured into sexual encounters with male prostitutes during their ten-year relationship. Surveillance footage showing Combs assaulting Ventura in a hotel corridor in Los Angeles was also presented to jurors.
Another ex-partner, referred to in the court documents as “Jane,” described being coerced into drug-influenced sexual activities, dubbed “hotel nights,” from 2021 to 2024.
Judge Subramanian dismissed the defense’s assertion that the encounters were consensual, stating that Combs exploited his authority and influence to take advantage of women psychologically, emotionally, and physically.
As of now, the appeals court has not arranged for oral arguments. Combs’ legal representation is pushing for either the conviction to be nullified, the sentence reduced, or an order for his immediate release.
