Ottawa Court Declares Mistrial in Infant Death Case Amid Guilty Verdict

A mistrial has been declared in Ottawa for Boravy Buth, who faced charges linked to the tragic death of her seven-week-old son in 2021. Her former partner, Patrick O’Connor, was convicted of second-degree murder after a protracted trial.

The tragic events unfolded in October 2021, leading to both Buth and O’Connor being charged in connection with the infant's demise. Buth also faced charges of criminal negligence causing death. However, the jury could not reach a decision on her charges, resulting in the mistrial, which opens the door for a possible retrial in the future.

Police had responded to an emergency call from the couple’s residence during the early hours, reporting that the baby was unresponsive. The trial revealed conflicting testimonies about the incident leading up to the infant's dire condition, with discrepancies noted between Buth and O’Connor's accounts of what transpired that evening.

The case relied heavily on medical insights. A forensic expert testified that the infant's injuries were severe and inconsistent with a mere fall from a bed, contradicting initial claims. These injuries resembled those associated with high-impact incidents and were indicative of potential child abuse, with earlier injury markers noted prior to the fatal event.

During the closing statements, both defence teams sought to shift blame onto each other, reflecting the case’s complexity and the jury’s struggle with the conflicting evidence presented. While O’Connor was held accountable, uncertainties surrounding Buth’s involvement lingered.

Following the guilty verdict, tensions arose in the courtroom, resulting in a brief disturbance from a relative of O’Connor. Law enforcement and court officials swiftly addressed the matter.

O’Connor is set to face sentencing in court, while Buth's legal situation remains in limbo following the mistrial declaration.
