Actor and musician Will Smith is currently facing legal challenges as violinist Brian King Joseph, who played during Smith’s Based on a True Story tour in 2025, has accused him of misconduct.
Brian King Joseph's lawsuit targets both Will Smith and Treyball Studios Management, with allegations of sexual harassment, retaliation, and wrongful termination. It is stated that Joseph was initially retained in November 2024 for a concert in San Diego and later invited to join Smith’s tour in 2025, along with upcoming music projects.
The lawsuit describes an evolving professional relationship where Smith reportedly made numerous personal comments indicating a special emotional bond. An excerpt from the lawsuit notes, “You and I share such a unique connection that I don’t have with anyone else.”
A specific incident during the Las Vegas leg of the tour in March 2025 is brought to light in the legal action. Joseph claims his hotel room key was unaccountably missing for hours before being returned by management, the only individuals who had access.
Upon returning to his hotel room, Joseph reported signs of unauthorized entry, stating he discovered items that were not his own, including wipes, HIV medication labeled with someone else's name, and a note addressed to him. This note allegedly stated, “Brian, I’ll be back no later [sic] than 5:30, just us,” accompanied by a heart and the name “Stone F.”
Joseph expressed feeling threatened by this message, fearing an intended return to his room without his approval. He promptly notified hotel security and the tour representatives, and proceeded to file a report with local authorities.
After reporting the events, Joseph alleges that he was falsely accused of fabrication by a management team member, leading to his dismissal from the tour.
The lawsuit claims that this termination inflicted severe emotional distress, which includes post-traumatic stress disorder symptoms, along with financial and career hardships. Joseph seeks damages for harassment, retaliation, and wrongful termination, with the amount to be decided by a jury.
