EU Alleges Meta Breached Child Safety Regulations

The European Commission has issued a preliminary finding indicating that Meta Platforms may have contravened EU digital safety regulations by not adequately shielding children from accessing Facebook and Instagram.

The Commission noted that Meta’s measures fell short in preventing users under 13 from gaining access to its platforms, despite established policies forbidding such registrations.

This investigation falls under the European Union’s Digital Services Act (DSA), which mandates that prominent online platforms take steps to protect vulnerable users, particularly minors, from unsafe digital environments.

EU regulators have criticized the current safeguards employed by Meta as inadequate, highlighting that children can easily circumvent age restrictions through false birthdate entries during sign-up. The lack of effective age verification systems that deter underage access is a significant concern.

Additionally, the Commission pointed out that Meta’s reporting frameworks are overly complicated for users. Investigators determined that users must navigate multiple steps before accessing the tools meant for reporting harmful or inappropriate content.

Regulators also claimed that Meta’s internal assessments downplayed the severity of the issue. Evidence suggests that around 10 to 12 percent of EU children under 13 still access Facebook and Instagram.

Henna Virkkunen, the EU's chief of technology, emphasized that online safety regulations must translate into actionable measures. Companies are urged to implement effective strategies to safeguard children and younger users online.

Meta has expressed disagreement with the initial findings yet acknowledged that age verification is a challenge industry-wide. The company plans to roll out enhanced safety measures soon.

This investigation commenced in May 2024, part of broader European initiatives aimed at increasing scrutiny of significant tech entities under the DSA. This law empowers EU regulators to investigate platforms regarding child safety, misinformation, harmful content, and user protection.

Should these preliminary findings be validated after further examination, Meta may face significant fines. EU regulations stipulate that firms found in grave violation of the DSA could incur penalties amounting to six percent of their global annual revenue, potentially reaching billions.

The situation underscores the international demand for enhanced safeguards for children on social media. Governments around the world are intensifying scrutiny on how digital companies manage underage users, harmful content, privacy issues, and mental health implications.

The European Commission is also investigating other social media platforms concerning child safety. Earlier this year, a similar inquiry into Snapchat was initiated regarding minor protection.

The EU’s actions signify a broader global discourse on the obligations of major tech companies toward younger audiences. Policymakers are increasingly advocating for more stringent identity verification, safer content moderation, and user-friendly reporting tools to mitigate online risks for children.

The investigation concerning Meta is ongoing, granting the company the chance to formally address the accusations and suggest corrective measures before any conclusive action is determined by European regulators.
