American rapper Eminem, known as Marshall B. Mathers III, has initiated a lawsuit against Swim Shady, a Sydney-based beachwear brand, arguing that their name closely resembles his trademarked persona, Slim Shady.
In September, Eminem submitted a request to the US Patent and Trademark Office, seeking to invalidate the trademark granted to Swim Shady. As per US regulations, the company must respond within the coming week. Eminem’s attorneys claim that Swim Shady's branding leads to a “false association” with the rapper.
In response to the legal challenge, Swim Shady announced its intention to protect its intellectual property vigorously. Launched in 2023, the brand sells beach umbrellas, swim bags, and other accessories, having obtained a US trademark for the name shortly before Eminem’s petition. Additionally, he has filed a trademark opposition in Australia.
Court documents reveal that Eminem secured the Slim Shady trademark in the US back in 1999, coinciding with the release of his acclaimed album. He later filed for the Australian trademark in January 2025. Eminem gained widespread recognition in 2000 with the Grammy-winning single, “The Real Slim Shady,” asserting that the name Slim Shady has gained unique recognition tied to his music career.
Swim Shady describes itself as an Australian enterprise dedicated to creating stylish and functional sun protection products, with legal backing from Sydney's Meyer West IP intellectual property law firm.
This case echoes a prior trademark dispute in Australia involving Katy Perry and designer Katie Perry, where the court ruled in favor of the local designer, aptly illustrating the “David versus Goliath” nature of trademark battles.
