A US judge has reopened a legal case to investigate whether officials of the Trump administration unlawfully deported hundreds of Venezuelan men to El Salvador back in March. This legal scrutiny revolves around whether these officials disregarded a court order issued in March that mandated the cessation of these deportations.
US District Judge James Boasberg announced on Wednesday that he will seek sworn testimonies from officials to ascertain if they violated his directives. “It seems that a factual inquiry is in order, and the best way to proceed would appear to be bringing in witnesses and having them testify under oath,” Boasberg remarked during a status conference.
Earlier this year, a trio of judges from a federal appeals court had temporarily halted the inquiry. Nevertheless, a larger panel subsequently ruled that Boasberg possesses the authority to identify the decision-makers and evaluate potential actions moving forward. If officials are found in breach of court orders, criminal contempt proceedings could result in fines or other forms of punishment.
Boasberg has requested the Justice Department to present a plan by November 24 outlining the subsequent steps. Attorneys for the deported individuals have also been asked to submit their suggestions. The Justice Department contests Boasberg’s jurisdiction, claiming that the administration did not intentionally contravene any court orders.
This lawsuit involves Venezuelan men deported under the seldom-used Alien Enemies Act. In April, Boasberg stated that the Trump administration seemed to act “in bad faith” by hastily organizing three deportation flights on March 15 while he was assessing the legality of the actions. The men were subsequently released from a Salvadoran prison this summer and returned to Venezuela due to a US-brokered prisoner exchange.
This case underscores ongoing disputes over presidential authority, legal constraints, and immigrants' rights within the United States.
