In a significant ruling after a week-long appeal, the Appellate Panel of the Supreme People's Court in Hanoi has modified the prison sentences of various former officials from the Vietnam Cement Corporation (VICEM). This decision pertains to violations uncovered during the construction project of VICEM's headquarters on Pham Hung Street. These violations included mismanagement of state assets leading to financial losses and serious breaches of bidding protocols.

The court deduced that the defendants' actions had detrimental economic repercussions and undermined public confidence in the stewardship of state property. The judges noted that these individuals held pivotal roles at VICEM and facilitated critical decision-making throughout the project's phases. Although there was no evidence of personal gain, the execution of the project deviated from established regulations, culminating in a significant, incomplete development.

During the appeals, the court took into account several new mitigating circumstances introduced by the defendants. Each acknowledged their involvement, assisted investigators, and expressed regret for their actions. Notably, the group managed to compensate the state by paying over 119 billion Vietnamese dong for the incurred losses. The court assessed various accolades and prior contributions from the defendants, underscoring their professional backgrounds.

Prominently, Nguyen Ngoc Anh, the ex-General Director of VICEM, experienced a notable alteration in sentence. His appeal for acquittal was denied, yet the judges acknowledged multiple mitigating factors related to his health, advanced age, and past service. Currently undergoing treatment for cancer at over 70, his prison term was lessened from 15 to 13 years for two charges.

Several other former officials witnessed similar reductions. Du Ngoc Long, who led the VICEM Project Management Board, had his sentence shortened from 12 years and 6 months to 9 years, while Hoang Ngoc Hieu saw his term reduced from 11 to 10 years following convictions linked to state asset mismanagement and bid irregularities.

Former Chairman Le Van Chung had his term modified from 13 to 10 years. Ta Quang Buu, previously a Deputy General Director and member of the Board, received a reduction from 9 to 7 years. The appellate court highlighted these modifications as indicative of the defendants' remedial endeavors and consideration of further mitigating circumstances raised during the appeal.

In its concluding statement, the court affirmed the seriousness of the offenses and the resultant necessity for punishment, while acknowledging the potential for humanitarian consideration and corrective actions taken post-offense. Additional defendants, including former executives from Vietnam Construction Consulting Corporation (VNCC), received similar reductions and suspended sentences. This ruling reflects the ongoing scrutiny surrounding state enterprise corruption and mismanagement in Vietnam, balancing accountability with the legal system's focus on rehabilitation.
