In a significant legal development, a tribunal in London has determined that Apple misused its dominant position by imposing unfair commissions on app developers. This ruling could potentially lead to Apple facing damages amounting to hundreds of millions of pounds.
The Competition Appeal Tribunal (CAT) in the UK ruled that Apple’s monopoly over the iPhone and iPad app marketplace from October 2015 through the end of 2020 hindered competition, allowing the firm to impose “excessive and unfair” fees on developers. This decision was part of a class action initiated on behalf of millions of UK iPhone users.
High Fees and Competitive Constraints
The litigation underscored that Apple’s typical 30 percent charge on app sales and in-app purchases greatly surpassed what could be labeled as reasonable, especially when contrasted with a 17.5 percent benchmark noted during the proceedings. The tribunal found that developers generally passed on about half of these inflated costs to consumers.
Legal experts and academics spearheading the case argued that Apple’s monopoly over app distribution enabled it to generate “exorbitant profits” while suppressing competition. This lawsuit represents one of the initial challenges to test the newer collective action framework in England, which aims to facilitate large-scale consumer lawsuits against powerful corporations.

Experts believe this case might pave the way for future mass claims against major technology firms, indicating that even industry leaders are bound by competition law.
