A court in Paris convened on Monday to consider former French president Nicolas Sarkozy's application for temporary release from prison, shortly after he began serving a five-year sentence for his role in illegal campaign financing tied to Libya’s Muammar Gaddafi. Prosecutors have suggested that Sarkozy can be released under judicial oversight while he awaits the outcome of his appeal.
Having led France from 2007 to 2012, Sarkozy was imprisoned on October 21 following a conviction in September for allegedly conspiring to solicit funds from Libya for his successful 2007 election bid. His sentence was enacted immediately due to the “extraordinary seriousness” of the offenses, as underscored by Judge Nathalie Gavarino.
Participating in the hearing via videoconference, Sarkozy labeled his incarceration as “gruelling,” though he acknowledged the efforts of prison personnel to make his experience manageable. The former leader vehemently denies any legal transgressions, asserting that the accusations are part of a “plot” associated with Gaddafi.
Under French law, pre-appeal detentions are considered exceptional. The court will evaluate whether Sarkozy poses a flight risk, could tamper with witnesses, or might obstruct justice. If granted release, he may face strict judicial supervision which could include electronic monitoring, financial guarantees, or regular reporting to authorities.
Prosecutor Damien Brunet argued that the request for release was justifiable, noting that risks of witness intimidation and collusion could be effectively managed under supervision. A ruling is anticipated at 1:30 pm (1230 GMT) on Monday.
Sarkozy is notably the first modern-era French head of state to face prison time. He previously served a one-year sentence with an electronic tag due to a separate corruption and influence-peddling case, which has since concluded. Additionally, he is currently under investigation for witness tampering in relation to the Libya case, with a resolution on 2012 campaign finance violations expected soon.
The decision from Monday’s proceedings could potentially see Sarkozy released from La Santé prison in just a few hours, under stringent monitoring, as France continues to grapple with unprecedented legal challenges involving a former president.
