Federal Court Blocks Michigan's Conversion Therapy Ban

The ongoing legal battle surrounding conversion therapy took a significant turn on Wednesday when a federal appellate court put a halt to Michigan's ban on the practice for minors. The 6th Circuit ruled that the ban infringes on the First Amendment rights of therapists, allowing them to express their beliefs. The court's decision, described as a victory for free speech supporters, may have broader implications for similar regulations throughout the country.

In a split decision of 2-1, the U.S. Court of Appeals emphasized that Michigan's law appeared to limit the expression of therapists who hold religious or philosophical views opposing traditional gender identities. The judges underscored that the state cannot promote a singular perspective while suppressing dissent. This ruling comes as a preliminary injunction was granted to Catholic Charities of Jackson, Lenawee, and Hillsdale Counties, which contended against the law's enactment.

Judge Raymond Kethledge authored the ruling, supported by Judge Joan Larsen, clarifying that while the law permits counseling that affirms gender transitioning, it effectively censors any supportive treatment of traditional gender identities. This discrimination, the court noted, stands in opposition to the free speech guarantees enshrined in the First Amendment.

A dissenting voice came from Judge Rachel Bloomekatz, who criticized the majority for acting prematurely, suggesting the court should have awaited a decision from the U.S. Supreme Court on a similar matter in Colorado. Her dissent points to the unsettled legal landscape and the potential for forthcoming Supreme Court guidance that could influence how states navigate conversion therapy laws.

Enacted in 2023 under a Democratic Legislature and signed by Governor Gretchen Whitmer, Michigan's law aimed to protect minors from conversion therapy, which proponents argue leads to severe mental health challenges. With more than 20 states imposing similar restrictions, the debate over conversion therapy remains fiercely contentious.

Conversion therapy efforts attempt to alter a person's sexual orientation or gender identity, a practice considered harmful and ineffective by many leading mental health organizations.
